End User License Agreement
IMPORTANT - READ CAREFULLY BEFORE USING THIS APPLICATION
By using Aqua Growth, you acknowledge that you have read, understood, and agree to be bound by the following terms and conditions.
1. NO WARRANTIES - PROVIDED "AS IS"
This application is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory. The developer makes NO WARRANTIES, express or implied, regarding: (a) the accuracy, reliability, or completeness of any recommendations, calculations, or data; (b) the fitness for any particular purpose; (c) merchantability; or (d) non-infringement. Use of this application is entirely at your own risk.
2. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: (a) loss of aquatic life or organisms; (b) damage to aquarium equipment; (c) property damage; (d) financial losses; (e) business interruption; (f) loss of data; or (g) any other damages arising from or related to the use or inability to use this application, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise).
3. NO PROFESSIONAL ADVICE
This application provides general information and computational tools only. It does NOT constitute professional aquaculture advice, veterinary advice, or expert consultation. You should always: (a) verify all recommendations with independent testing; (b) consult qualified professionals before making significant changes to your aquarium; and (c) use your own judgment and expertise. The developer is not responsible for any decisions made based on information provided by this application.
4. USER RESPONSIBILITY
You are solely responsible for: (a) verifying all calculations and recommendations; (b) monitoring your aquarium parameters; (c) the health and welfare of all aquatic organisms in your care; (d) complying with all applicable laws and regulations; and (e) any consequences resulting from actions taken based on this application. Always test water parameters independently before making adjustments.
5. GDPR & DATA PROTECTION (EU Users)
All data is stored locally on your device. This application does NOT: (a) collect personal data; (b) transmit data to external servers; (c) track user behavior; or (d) share information with third parties. You retain full control over your data. You may delete all data at any time by uninstalling the application.
6. EXPERIMENTAL NATURE
This application uses adaptive algorithms and predictive models that are experimental in nature. Results may vary significantly based on individual aquarium conditions. The developer makes no guarantees regarding the accuracy, stability, or suitability of these algorithms for your specific use case.
7. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless the developer from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use of this application; (b) your violation of this agreement; or (c) your violation of any rights of any third party.
8. GOVERNING LAW & JURISDICTION
This agreement shall be governed by and construed in accordance with the laws of the European Union and your local jurisdiction. Any disputes shall be subject to the exclusive jurisdiction of the courts in your jurisdiction. If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
9. SEVERABILITY & ENTIRE AGREEMENT
This agreement constitutes the entire agreement between you and the developer regarding the use of this application. If any provision is deemed unenforceable, it shall be modified to the minimum extent necessary to make it enforceable, or if that is not possible, severed, and the remaining provisions shall continue in full force.
CRITICAL SAFETY NOTICE
ALWAYS independently test your water parameters before making any changes. NEVER rely solely on this application's predictions. Improper dosing can harm or kill aquatic life. When in doubt, err on the side of caution and consult experienced aquarists or professionals.
